Uhlelo oluqhubekayo lokuthatha umhlalaphansi luvulekele abasebenzi abahlangabezana nale mibandela elandelayo:

ukusebenza isikhathi esithile ngaphakathi kwencazelo ye-Article L. 3123-1 yeKhodi Yezabasebenzi; sebefinyelele iminyaka yobudala esemthethweni yokuthatha umhlalaphansi (iminyaka engama-62 kubantu abanomshwalense abazalwa ngo-January 1, 1955 noma ngemva kwalokho) yehliswe ngeminyaka emi-2, ngaphandle kokukwazi ukuba neminyaka engaphansi kwama-60; zithethelela ubude besikhathi sezingxenye eziyi-150 zomshwalense wabantu abadala kanye nezikhathi eziqashelwa njengezilingana (Ikhodi Yokuphepha Komphakathi, art. L. 351-15).

Lolu hlelo luvumela abasebenzi ukuthi basebenzise umsebenzi owehlisiwe ngenkathi behlomula engxenyeni yempesheni yabo yomhlalaphansi. Le ngxenyana yempesheni iyehluka kuye ngobude besikhathi setoho.

Okukhathazayo ukuthi ngaphakathi kwencazelo yeKhodi Yezabasebenzi, kubhekwa njengabasebenza itoho, abasebenzi abanesikhathi esifushane sokusebenza:
