Compensation paid to the employee

Taking into account the health situation, the entry into force of the reformed system of the partial activity of common law (initially scheduled for November 1, 2021) is finally postponed to January 1, 2021. Thus, until December 31, 2020, the Partial activity compensation paid by the employer to the employee remains set at 70% of the gross hourly reference compensation (Labor C., art. R. 5122-18).

Decree n ° 2020-1316 also provides details on the accumulation of the compensatory allowance for paid leave and the partial activity allowance. From 1 November, when the paid vacation is due in the form of a compensatory allowance, this allowance is paid in addition to the partial activity allowance.

As of January 1, 2021, the rate rises to 60% of the reference hourly wage; the reference salary being limited to 4,5 times the hourly minimum wage. In principle, there will no longer be an increased reimbursement for the benefit of the protected sectors.

On the issue of calculating compensation, Decree No. 2020-1316 of October 30, 2020 specifies the terms and conditions for calculating compensation for employees receiving elements of variable compensation or paid at a non-regular basis.
