Sick leave: notify the employer as soon as possible

The employee on sick leave must, first of all and as quickly as possible, notify his employer. Regardless of the means used (telephone, email, fax), they benefit, except in the case of more favorable contractual or contractual provisions, from a maximum period of 48 hours to act. In addition, he is required to justify his absence by sending a medical certificate of sick leave. This certificate (form Cerfa n ° 10170 * 04) is a document drawn up by Social Security and completed by the doctor being consultation. It consists of three parts: two are intended for the primary health insurance fund (CPAM), one for the employer.

The certificate must be sent to the employer (part 3 of the form) within the time limits provided for in the collective agreement or, failing that, within a 'reasonable time limit'. To avoid any dispute, it is therefore always preferable tosend your sick leave within 48 hours.

Likewise, you only have 48 hours to send parts 1 and 2 of your sick leave to the medical service of your health insurance fund.
