My company has exceeded the threshold of 50 employees and I will therefore calculate the professional equality index. We belong to a SIU. Are there specific rules in this context?

Concerning the professional equality index and the UES, certain clarifications should be made concerning, in particular, the framework for the calculation and the publication of results.

On the level of calculation of the index in case of UES

In the presence of a UES, recognized by collective agreement, or by court decision, as soon as the CSE is set up at UES level, the indicators are calculated at UES level (Labor Code, art. D . 1142-2-1).

Otherwise, the index is calculated at company level. It does not matter whether there are several establishments or whether the company is part of a group, the calculation of the indicators remains at the level of the company.

On the determination of the workforce which requires calculating the index

The index is compulsory from 50 employees. If your company is part of a SIU, this threshold is assessed at the level of the SIU. Regardless of the size of the companies that make it up, the workforce taken into account for the calculation of the index is the total workforce of the UES.

On the publication of the index

The Ministry of Labor specifies
