Progressive retirement: person providing a part-time activity

The progressive retirement scheme is open to employees who meet the following conditions:

work part-time within the meaning of Article L. 3123-1 of the Labor Code; have reached the legal minimum retirement age (62 years for insured persons born on or after January 1, 1955) reduced by 2 years, without being able to be less than 60 years; justify a duration of 150 quarters of old-age insurance and periods recognized as equivalent (Social Security Code, art. L. 351-15).

This system allows workers to exercise reduced activity while benefiting from a portion of their retirement pension. This fraction of the pension varies according to the duration of part-time work.

The concern is that within the meaning of the Labor Code, are considered part-time, employees who have a shorter working time:

to the legal duration of 35 hours per week or to the duration fixed by collective agreement (branch or company agreement) or to the working duration applicable in your company if the duration is less than 35 hours; the resulting monthly duration,
