Can your employees smoke on the premises of your company?

It is forbidden to smoke in places assigned to collective use. This prohibition applies in all closed and covered places which welcome the public or which constitute workplaces (Public Health Code, article R. 3512-2).

Your employees may therefore not in any case smoke in their offices (whether individual or shared) or in the interior of the building (hallway, meeting rooms, rest room, dining room, etc.).

Indeed, the prohibition applies even in individual offices, in order to protect from the risks associated with passive smoking all the people who could be brought to pass in these offices, or to occupy them, even a brief moment. whether it is a colleague, a customer, a supplier, agents in charge of maintenance, upkeep, cleanliness, etc.

However, as soon as a workplace is not covered or closed, it is possible for your employees to smoke there.
