Teleworking on the recommendation of the occupational physician: do you have to comply?

A letter from occupational medicine recommends the teleworking of an employee until the pandemic of Covid-19 comes to an end. Do I necessarily have to respond favorably and set up remote work? What are my options when faced with this medical recommendation?

Occupational medicine: employee protection

Know that the occupational physician may, when it deems it necessary and is justified by considerations relating in particular to the age or the physical and mental state of the worker, propose in writing:

  • individual measures for fitting out, adapting or transforming the workstation;
  • working time arrangements (Labor Code, art. L. 4624-3).

Therefore, the occupational physician can completely recommend the installation of the teleworking for an employee until the health situation related to Covid-19 has improved.

According to the national protocol to ensure the health and safety of company employees in the face of the Covid-19 epidemic, recourse to teleworking must be the rule for all activities that allow it. The working time performed remotely is increased to 100% for employees who can perform all of their tasks remotely.
