Your payslip allows you to justify your income. Indispensable to your administrative life, this document is very important. It helps you demonstrate the number of years you have worked. It is used to check that everything to which you are entitled has been paid to you. It is therefore crucial proof that you must keep for life. Losing it or not receiving it can have serious consequences. You must, if it does not reach you on time, react immediately and demand that it be handed over.

What is a payslip?

You and your employer are normally bound by a formal employment contract. The work you provide them on a daily basis is paid in return. In compliance with the legislation in force, you receive your salary at strict intervals. Usually you get paid on a monthly basis. Towards the start or end of each month.

The payslip specifies in detail all the sums paid to you for this period. According to article R3243-1 of the Labor Code, the report must contain your hours worked, your overtime hours, your absences, your paid holidays, your bonuses, your benefits in kind, etc.

In what format to get it?

Due to the current digitalization, the dematerialization of the payslip has become common in French companies. This standard is now established in France. It is therefore possible to collect an edited version or a computer transcription of this bulletin.

According to article L3243-2 of the Labor Code, the employee has the right to oppose this system and can choose to continue to receive his payslip in paper format.

You should also know that your employer is subject to a fine of 450 euros if he does not deliver your payslip to you. This sum is granted for each file not submitted. You can also benefit from damages and interest due to the non-issuance of a payslip. Indeed when the employee has not been able to receive unemployment benefits or a bank loan has been refused. One can imagine that he feels he has been wronged and decides to take his case to court.

How to get your payslip?

The different solutions in case of loss of your payslips

Request a copy. It's the easiest and fastest way to get new copies of your payslips. All you need to do is contact your employer to ask them to issue you a copy of the said document. The personnel administration department can then provide you with a duplicate of those you have lost.

However, you should also know that no law requires your employer to produce a duplicate of these documents. This is not written into the labor code. To this end, he can refuse your request. And this even if article L. 3243-4 obliges your employer to keep a copy of your payslip for a minimum period of 5 years. Therefore, you must ensure that you use the correct tone in your mail if you need to request duplicates.

What other supporting documents can I use?

Since your company does not deliver the copy (s) to you, you can always ask them for a certificate certifying the period during which you have worked. This salary certificate is just as valid in terms of legal and administrative. A work certificate can also do the trick.

If ever, by these means, you do not yet obtain traceability of your salary, the solution may be found with your bank. Your bank statements detail the transfers you have received from your employer. You can obtain these records from your account manager. You just need to initiate the request by written request. This service is often paid.
