Rate of the indemnity and partial activity allowance: common law regime

In partial activity, you pay employees an hourly compensation corresponding to 70% of their gross remuneration. The maximum remuneration for the calculation of the indemnity is limited to 4,5 SMIC.

As of February 1, 2021, the hourly rate of the allowance was to increase to 60% of the gross reference remuneration. This decrease is postponed to March 1. Thus, the hourly rate of the allowance remains fixed at 70% until February 28 inclusive.

The provision which provides that the net indemnity paid may not exceed the employee's usual net hourly remuneration and which specifies that the net indemnity and remuneration are understood to be after deduction of the mandatory contributions and contributions withheld by the employer should apply from February 1. But its entry into force is also postponed to March 1, 2021.

Until January 31, 2021, the hourly rate of the partial activity allowance was set at 60% of the gross hourly remuneration of the employee concerned within the limit of 4,5 hourly minimum wage. It was to increase to 36% of the employee's previous gross salary as of February 1, 2021.
